Injured persons should not ignore legitimate claims. With each successive stage of the proceedings, the costs will usually increase and can thus add up significantly.
In addition, there is the threat of legal consequences in the course of the proceedings, such as a reminder and an enforcement order from the court. On this basis, there may even be a threat of enforcement.
Therefore, it is better to contact us as early as possible to avoid additional costs and to agree on an amicable settlement of the claim.
If you have already paid the claim or consider it fundamentally unjustified, please inform us as soon as possible.
We will then stop the debt collection process and clarify the case with our client (and request additional evidence if necessary).
Even without a prior reminder from the supplier/service provider, you can receive the receivables through us.
The decisive factor is that you are in default (e.g. if the payment deadline stated in the invoice has been exceeded).
Collection fees are generally legal if the principal claim is justified and the debtor is in default of payment pursuant to Section 286 (1) BGB.
Through the assignment and the documents submitted with it, we assume that the claim is justified and that you must also pay it.
In principle, however, you only have to pay a debt collection claim if it is legitimate. This means that there must be a claim (e.g. an unpaid invoice) and you must be in arrears with the payment. But then you are also obliged to pay.
